Privacy Policy

adaptiveplatformlab ("Company," "we," "us," or "our") operates the website and enterprise software services. This Privacy Policy describes how we collect, use, store, share, and protect your personal information when you interact with our systems, services, and platforms.

1. Information We Collect

We collect information you provide directly: name, email address, phone number, company affiliation, job title, billing information, and any data submitted through contact forms or service inquiries. We also automatically collect IP addresses, browser type, operating system, referral URLs, and usage patterns through server logs and analytics tools.

2. Legal Basis for Processing

Under the General Data Protection Regulation (GDPR), we process your data based on: (a) contractual necessity — to fulfill service agreements; (b) legitimate interest — to improve our systems and respond to inquiries; (c) consent — when you subscribe to communications or accept cookies; (d) legal obligation — to comply with tax, accounting, and regulatory requirements.

3. How We Use Your Information

Your data enables us to: deliver and maintain enterprise software services, process transactions and generate invoices, communicate regarding support and system updates, analyze usage patterns to optimize performance, comply with legal obligations, and protect against unauthorized access or fraud.

4. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes outlined in this policy. Active client data is retained for the duration of the service relationship plus 24 months. Contact form submissions are retained for 12 months. Financial records are retained for 7 years per Danish tax regulations.

5. Data Security

We implement industry-standard security measures including TLS 1.3 encryption for data in transit, AES-256 encryption for data at rest, role-based access controls, regular penetration testing, and continuous monitoring systems. Our infrastructure undergoes annual SOC 2 Type II audits.

6. Your Rights Under GDPR

You have the right to: access your personal data, rectify inaccurate data, erase your data ("right to be forgotten"), restrict processing, data portability, object to processing, and withdraw consent at any time. To exercise these rights, contact our Data Protection Officer at [email protected].

7. International Data Transfers

Data may be transferred to and processed in countries outside the European Economic Area. Where such transfers occur, we ensure adequate protection through Standard Contractual Clauses (SCCs) approved by the European Commission or adequacy decisions.

Terms of Service

These Terms of Service ("Terms") govern your use of enterprise software systems, consulting services, and technical solutions provided by adaptiveplatformlab ("Company," "we," "us," or "our"). By engaging our services, you agree to be bound by these Terms.

1. Service Scope

adaptiveplatformlab provides enterprise software architecture, system integration, workflow automation, data pipeline construction, and related technical consulting services. Each engagement is governed by a Statement of Work (SOW) specifying deliverables, timelines, and acceptance criteria.

2. Intellectual Property

Upon full payment, clients receive a perpetual, non-exclusive license to use all custom-developed software, configurations, and documentation delivered under the engagement. adaptiveplatformlab retains ownership of pre-existing frameworks, libraries, and methodologies used in service delivery.

3. Payment Terms

Invoices are issued according to the payment schedule defined in the SOW. Payment is due within 30 days of invoice date. Late payments incur a 1.5% monthly interest charge. All prices exclude applicable taxes (VAT/Moms).

4. Confidentiality

Both parties agree to maintain strict confidentiality of proprietary information exchanged during the engagement. This obligation survives termination for a period of 36 months. Confidential information includes trade secrets, business strategies, technical architectures, and client data.

5. Limitation of Liability

adaptiveplatformlab's total liability shall not exceed the total fees paid under the applicable SOW. We are not liable for indirect, incidental, consequential, or punitive damages. This limitation does not apply to breaches of confidentiality or data protection obligations.

6. Warranty

We warrant that services will be performed in a professional manner consistent with industry standards. Software deliverables are warranted to function as specified in the SOW for a period of 90 days following acceptance. Warranty does not cover modifications made by the client or third parties.

7. Termination

Either party may terminate with 30 days written notice. Upon termination, the client pays for all work completed to date. Confidential data is returned or destroyed within 14 days of termination.

8. Governing Law

These Terms are governed by Danish law. Disputes shall be resolved through the Danish courts, with Odense as the venue for legal proceedings.

5. Cookie Duration

Refund Policy

adaptiveplatformlab is committed to delivering enterprise software solutions that meet agreed-upon specifications. This Refund Policy outlines the conditions under which refunds may be issued for services rendered.

1. Project Deposits

Initial deposits (typically 30-50% of project value) are non-refundable once work has commenced. Deposits secure scheduling, resource allocation, and project initiation. If cancellation occurs before work begins, a full deposit refund will be issued within 14 business days.

2. Milestone Payments

Payments for completed milestones are non-refundable once the milestone deliverables have been delivered and accepted. If a deliverable fails to meet the acceptance criteria defined in the Statement of Work, we will rectify the deficiency at no additional cost or issue a partial refund for the affected milestone.

3. Subscription Services

Monthly subscription services may be cancelled at any time with 30 days written notice. No refund is issued for the current billing period. Annual subscriptions may be refunded on a pro-rata basis for unused months, minus a 15% administrative fee.

4. Dispute Resolution

If you believe a refund is warranted, submit a written request to [email protected] within 30 days of the invoice date. We will review the request within 5 business days. Disputes that cannot be resolved amicably will be subject to mediation before legal proceedings.

5. Refund Processing

Approved refunds are processed within 14 business days to the original payment method. For wire transfers, refunds are issued to the originating bank account. VAT/Moms refunds are handled in accordance with Danish tax regulations.

6. Force Majeure

adaptiveplatformlab is not liable for refunds due to circumstances beyond our reasonable control, including natural disasters, government actions, cyberattacks, or third-party service failures. In such cases, we will work to resume operations as quickly as possible.
